1. Acceptance and legal effect
These Terms of Service ("Terms") govern access to and use of lineman.ca, connected Lineman Canada services, and related applications, communications, content, memberships, training workflows, job, project and storm-work tools, employer tools, marketplace features and payment services (collectively, the "Platform"). The Platform is operated by Lineman Canada ("Lineman Canada", "we", "us" or "our").
By creating an account, clicking an acceptance box, purchasing a plan, submitting information, or otherwise using the Platform, the user ("you") agrees to these Terms and the Privacy Policy, Marketplace, Training & Employment Terms, and Cookie & Communications Notice, each incorporated by reference. If you accept for a business or organization, you represent that you have authority to bind it. If you do not agree, do not use the Platform.
2. Platform role; no professional, employment or training guarantee
Lineman Canada is a technology platform and facilitator. We may provide tools to connect students, workers, employers, trainers, training providers, contractors and industry partners, but we do not employ, supervise, direct, certify, credential, train, assess, dispatch, endorse, investigate, insure, warrant, or guarantee any user, provider, opportunity, job, project, training, credential, content, payment, result, safety outcome, qualification, availability, lawful status, or performance unless a separate written agreement expressly says otherwise.
No Platform listing, profile, credential display, proposal, completion status, messaging, content, recommendation, ranking or administrative action is a representation that a person or organization is competent, safe, licensed, insured, legally eligible, qualified, certified, available, suitable, or approved for a particular role, site, task, training, equipment, voltage, project or jurisdiction.
3. Eligibility, account security and identity
You must be the age of majority in your province or territory and able to form a binding contract, or use the Platform only through a parent, guardian, school or employer that has expressly accepted responsibility. You must provide accurate, current and complete information, keep it updated, protect your credentials, and immediately notify us of suspected unauthorized access.
You are solely responsible for all activity through your account, including any account created for or used by your organization. Lineman Canada may require verification, limit functions, suspend access, merge duplicate records, correct data, or reject any account or content in its discretion, subject to applicable law.
4. User responsibilities and prohibited use
You are responsible for independently verifying the identity, qualifications, licence status, trade status, references, insurance, safety training, fitness for duty, certifications, right to work, site readiness, legal compliance and suitability of every person, employer, trainer, provider, service, opportunity and transaction you encounter. Employers and trainers remain responsible for all hiring, onboarding, screening, supervision, instruction, competency assessment, safety management, payroll, taxes, benefits, insurance and legal compliance.
You must not: provide false, misleading, unlawful, infringing, discriminatory, harassing, unsafe or harmful material; post a job or training offer that is not genuine; impersonate anyone; scrape, harvest, reverse engineer, interfere with security, send spam, introduce malicious code, evade fees or controls, misuse personal information, violate privacy or intellectual-property rights, or use the Platform in violation of law, regulation, collective agreement, site rule or safety requirement.
5. User content and licence
You retain ownership of content you submit, including profiles, postings, images, documents and messages ("User Content"). You grant Lineman Canada a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, reproduce, format, display, distribute and otherwise use User Content solely to operate, secure, improve, market and provide the Platform and related services. You represent that you hold all rights, permissions and consents required for that use.
You are solely responsible for User Content and its consequences. We may remove, restrict, preserve or disclose User Content when reasonably necessary to operate the Platform, investigate abuse, comply with law, protect users or enforce these Terms.
6. Payments, subscriptions and third parties
Fees, billing intervals, included features, taxes, renewal and cancellation terms will be disclosed at checkout or in the applicable plan. Recurring plans renew automatically unless cancelled before the next billing date. Payments are processed by Stripe or another disclosed processor; you authorize the processor and us to charge the selected payment method. Except where required by law or expressly stated in writing, fees are non-refundable, including unused subscription time, training requests, marketplace fees and administrative charges.
Third-party sites, services, payment processors, trainers, employers, contractors and advertisers have their own terms and privacy practices. Lineman Canada is not responsible for third-party acts, omissions, availability, information, goods or services.
7. Safety-critical activities
The Platform must never replace competent supervision, a written work plan, hazard assessment, job briefing, utility or owner authorization, applicable law, employer policies, manufacturer instructions, or professional safety judgment. Electricity, line work, live-line work, storm work, climbing, equipment use and field training can cause serious injury, death and property damage. Do not rely on Platform content or communications as operational direction or certification. Stop work and follow site and emergency procedures whenever conditions require.
8. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL CONTENT, LISTINGS, INFORMATION, CONNECTIONS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." LINEMAN CANADA DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, QUALITY, CONTINUITY AND RESULTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINEMAN CANADA AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSS; LOSS OF DATA, PROFITS, BUSINESS, OPPORTUNITY, REPUTATION OR GOODWILL; OR ANY INJURY, DEATH, PROPERTY DAMAGE, EMPLOYMENT, TRAINING, PAYMENT, MISREPRESENTATION, SAFETY, SITE, USER OR THIRD-PARTY CLAIM ARISING FROM OR RELATED TO THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF CAD $100 OR THE FEES YOU PAID TO LINEMAN CANADA FOR THE RELEVANT PLATFORM SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited by law.
10. Indemnity
To the maximum extent permitted by law, you will defend, indemnify and hold harmless Lineman Canada and the persons listed above from claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from your User Content, account, transactions, breach of these Terms, violation of law, negligence, misconduct, safety incident, employment, training, service delivery, use of information or interaction with any user or third party.
11. Suspension, termination and changes
We may suspend, restrict or terminate access, remove content, cancel transactions or preserve information where we reasonably believe it is necessary for security, misuse prevention, legal compliance, non-payment, risk management or enforcement. We may change the Platform or these Terms. Material changes will be posted with a new effective date and, where legally required, communicated to you. Continued use after the effective date is acceptance.
12. Governing law, disputes and general terms
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without regard to conflict rules. Courts located in Alberta have exclusive jurisdiction, except where consumer-protection law requires otherwise. Before commencing a claim, you agree to provide written notice to support@lineman.ca and allow 30 days to attempt resolution. If any provision is unenforceable, it will be severed or limited and the remainder remains effective. These Terms are the entire agreement about the Platform, except for any separate written agreement.
